1. Introduction
Welcome to AutoRent. By accessing or using our website, mobile application, or services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services. AutoRent provides a peer-to-peer car rental marketplace connecting vehicle owners ("Hosts") with renters ("Guests"). These terms apply to all users, including Hosts, Guests, and visitors.
2. Eligibility & Account Registration
To use AutoRent, you must be at least 21 years old and possess a valid driver's license. You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. AutoRent reserves the right to suspend or terminate accounts that violate these terms or applicable laws.
3. Rental Terms for Guests
• Booking Confirmation: A booking is confirmed only after full payment is processed and you receive a confirmation email.
• Pickup & Return: You must pick up and return the vehicle at the agreed time and location. Late returns may incur additional fees.
• Fuel Policy: Vehicles must be returned with the same fuel level as received, unless otherwise agreed.
• Mileage Limits: Some rentals may include mileage limits; exceeding limits will result in extra charges.
• Damage & Cleaning: You are responsible for any damage to the vehicle during your rental period. Excessive cleaning fees may apply.
• Prohibited Uses: Towing, racing, off-road driving, smoking, and transporting illegal items are strictly prohibited.
4. Host Obligations
• Listing Accuracy: Hosts must provide accurate descriptions, photos, and availability for their vehicles.
• Vehicle Condition: Hosts warrant that their vehicles are roadworthy, properly maintained, and meet all legal safety standards.
• Insurance: Hosts must maintain valid insurance coverage for their vehicles as required by law.
• Cancellation Policy: Hosts who cancel confirmed bookings may be subject to penalties and loss of listing privileges.
• Pricing: Hosts set their own daily rates but agree to honor confirmed bookings at the agreed price.
5. Payments, Fees & Taxes
AutoRent collects rental fees on behalf of Hosts. Our service fee is 10% of the subtotal, plus applicable taxes. Guests pay the total amount at booking confirmation. Hosts receive payouts within 5-7 business days after rental completion, minus our service fee. All prices are in USD unless otherwise stated. You are responsible for any taxes, duties, or levies imposed by your jurisdiction.
6. Cancellation & Refund Policy
• Guest Cancellation: Cancellations made 48+ hours before pickup receive a full refund. Cancellations within 48 hours receive a 50% refund. No-shows are non-refundable.
• Host Cancellation: If a Host cancels, Guests receive a full refund, and AutoRent may offer a credit toward a future booking.
• Early Returns: No refunds for early vehicle returns unless agreed in writing.
• Force Majeure: AutoRent is not liable for cancellations due to natural disasters, pandemics, or other unforeseen events.
7. Insurance & Liability
AutoRent does not provide insurance coverage. Guests are responsible for obtaining their own insurance or purchasing coverage through the platform if available. Hosts' personal insurance may not cover commercial rentals; consult your provider. To the maximum extent permitted by law, AutoRent is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the booking.
8. Intellectual Property
All content on the AutoRent platform, including logos, text, graphics, and software, is the property of AutoRent or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of our service without written permission. Hosts grant AutoRent a non-exclusive license to display their vehicle listings and photos.
9. Privacy & Data Protection
Your privacy is important to us. We collect personal information such as name, email, phone number, driver's license, and payment details to facilitate bookings. We use industry-standard encryption and do not sell your data to third parties. You have the right to access, correct, or delete your personal information. 10. Modifications to Terms
AutoRent reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this page. Your continued use of the service after changes constitutes acceptance of the new terms. Material changes will be notified via email or platform notification.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of California. Any dispute arising from these terms or your use of AutoRent shall be resolved through binding arbitration in Los Angeles, CA, unless otherwise agreed in writing. You waive the right to participate in class actions.
